MINUTE ORDER: This matter is before the Court on the #95 Plaintiff's Renewed Motion for Recusal and Disqualification of Magistrate Judge N. Reid Neureiter and District Judge Nina Y. Wang Pursuant to 28 U.S.C. 144 and 455; Motion to Vacate All Substantive Orders Issued While Recusal Motions and Affidavits of Bias Were Pending; Objection to Any Substantive Ruling at the March 30, 2026 Status Conference; and Request for Immediate Reassignment. To the extent the Motion seeks the recusal of the undersigned or of Magistrate Judge Neureiter under 28 U.S.C. 144, this portion of the Motion is procedurally improper. Section 144 permits a party to seek recusal by "fil[ing] a timely and sufficient affidavit that the judge before whom the matter is pending has a personal bias or prejudice either against him or in favor of any adverse party"; the affidavit must "state the facts and the reasons for the belief that bias or prejudice exists." 28 U.S.C. 144. Plaintiff's Motion is not accompanied by a required affidavit, nor could it be: a party "may file only one such affidavit in any case," id., and Plaintiff already filed an affidavit when he sought this Court's recusal under 144 in December 2025, see [Doc. 43 at 7]. If Plaintiff is attempting to incorporate that affidavit into his pending Motion by reference, such incorporation is not permitted by the Federal Rules of Civil Procedure, and the Court has already determined that that affidavit did not provide sufficient grounds for recusal under 144. See [Doc. #71 ]. For these reasons, his requests for recusal under 144 are not procedurally proper and are respectfully DENIED. See Gedeon v. Att'y Gen., No. 22-cv-03595, 2023 WL 5278711, at *3 (E.D. Pa. Aug. 16, 2023) (explaining that denial of successive motions under 144 is appropriate); Celli v. New York City, No. 24-cv-09743-JPC-RWL, 2025 WL 1908386, at *1 (S.D.N.Y. June 9, 2025) (finding second motion under 144 "procedurally improper"). To the extent the Motion seeks this Court's recusal under 28 U.S.C. 455, the Court adopts and reiterates its ruling in its February 24, 2026 Order denying Plaintiff's similar motion for recusal under 455. See [Doc. #71 ]. The Court continues to conclude that the Court's rulings and orders in this case would not cause a reasonable person, knowing all of the relevant facts, to harbor doubts about the Court's impartiality. David v. City and Cnty. of Denv., 101 F.3d 1344, 1350 (10th Cir. 1996); United States v. Walker, 838 F. App'x 333, 337 (10th Cir. 2020) (adverse rulings do not provide a basis for recusal). Accordingly, this portion of the Motion and the portion of the Motion requesting that the case be reassigned are respectfully DENIED. To the extent the Motion seeks the recusal of Judge Neureiter under 28 U.S.C. 455 or requests other forms of relief, this remaining portion of the Motion is REFERRED to Magistrate Judge N.
