MINUTE ORDER: This matter is before the Court on the parties' Joint Motion to Vacate the May 19, 2026 Hearing and Approve Stipulation re: Defendant City of Boulder's Motion to Stay. ECF No. #50 . For good cause shown, and after consideration of the factors enunciated in String Cheese Incident, LLC v. Stylus Shows, Inc., No. 02-cv-01934-LTB-PA, 2006 WL 894955, at *2 (D. Colo. Mar. 30, 2006), the parties' Joint Motion To Stay, ECF No. #50 , is GRANTED. A partial stay will not prejudice the plaintiff, who does not oppose the motion, ECF No. #50 , will avoid burdening the parties with the costs of litigating, promotes judicial economy and efficiency, has no impact on nonparties, and is in the public interest. Accordingly, it is ORDERED that: Rule 30(b)(6) depositions of the City of Boulder will be stayed pending the Court's ruling on the City of Boulder's Motion to Dismiss; the City will not limit the plaintiff's non-30(b)(6) depositions beyond standard objections under the Federal Rules of Civil Procedure, the local rules, and subject to the Scheduling Order; if documents come to light during depositions related to the plaintiff's Monell claim that are within the custody and control of the City of Boulder, the plaintiff may propound no more than three Rule 34 requests for production to the City while the Motion to Dismiss is pending; the plaintiff shall not propound interrogatories or requests for admission to the City unless the Motion to Dismiss is denied; and if the Motion to Dismiss is denied, the Parties agree that the discovery cut-off and expert disclosure deadlines related to the Monell claim will be extended. Entering so, the Court further orders that the Motion to Stay, ECF No. #31 , be DENIED as moot. It is FURTHER ORDERED that the Motions Hearing scheduling for May 19, 2026 is VACATED. Entered by Magistrate Judge Cyrus Y. Chung on 05/18/2026. Text Only Entry.(agryan)
