MINUTE ORDER granting 20 Motion to Consolidate Cases re: #9 Notice of Filing Motion to Consolidate. This matter is before the Court on Plaintiffs' Motion to Consolidate Related Cases for All Purposes Through Trial ("Motion to Consolidate"). [Doc. 20 ]. Plaintiffs assert that "[a]ll three plaintiff groups support consolidation for all purposes." [Id. at 2]. Defendants' counsel authorized Plaintiffs to indicate that "Defendants agree that consolidation through discovery is appropriate, but they oppose consolidation for trial." [Id. at 1]. Pursuant to Local Rule 7.1(d), the Court addresses the Motion to Consolidate without waiting for a response. Accordingly, it is ORDERED that: (1) Plaintiffs' Motion to Consolidate Related Cases for All Purposes Through Trial [Doc. 20 ] is GRANTED; (2)Pursuant to Federal Rule of Civil Procedure 42 and D.C.COLO.LCivR 42.1,the Clerk of Court shall CONSOLIDATE this case with Conklin v. Gold MineTours, Inc., Civil Action No. 25-cv-04146-CNS-MDB and Spence v. GoldMine Tours, Inc., Civil Action No. 25-cv-04122-TPO; (3) All filings shall be made in this action, under the caption of: Civil Action No. 25-cv-04049-NYW-MDB Consolidated with Civil Actions No. 25-cv-04122-NYW-MDB and No. 25-cv-04146-NYW-MDB; (4) The Clerk of Court is DIRECTED to assign the magistrate judge referral duties in Civil Action No. 25-cv- 04122 to Magistrate Judge Maritza Dominguez Braswell; and (5) The Parties are ORDERED to jointly contact Judge Dominguez Braswell's Chambers within seven days for the purpose of scheduling a Status Conference to discuss preparation of a combined Scheduling Order.
