MINUTE ORDER: The #40 Motion to Produce is DENIED. Mr. Bujanda, I am denying your request for documents because discovery has not yet started. This means the parties cannot begin to exchange documents and other information, yet. Furthermore, two of the Defendants in this case have not been served yet. Discovery will begin once any motions to dismiss are resolved, and once Defendants answer in response to any claims that survive their motions to dismiss. I understand you are eager to receive certain documents from Defendants, but I have already denied this premature discovery request once before. See ECF 38. This order constitutes a second denial for the same reasons. Thus, any future requests to receive documents before discovery opens will result in a denial without further explanation. Additionally, in light of the filing of the #39 Amended Complaint, the #30 Motion to Dismiss is found moot. Davis v. TXO Prod. Corp., 929 F.2d 1515, 1517 (10th Cir. 1991) (It is well established that an amended complaint ordinarily supersedes the original and renders it of no legal effect.); Strich v. United States, 2010 WL 148269, at *1 (D. Colo. Jan. 11, 2010) (The filing of an amended complaint moots a motion to dismiss directed at the complaint that is supplanted and superseded) (citations omitted). MINUTE ORDER: The Court previously directed Plaintiff to file an amended complaint identifying the two Doe Defendants and including any necessary amendments. ECF 32. For good cause shown, Plaintiff's #33 Motion for Extension of Time to Amend Complaint is granted and his deadline to file the amended complaint is extended through August 7, 2026.Plaintiff's #26 Motion to Appoint Limited Representation is denied without prejudice. While the Court acknowledges the significant challenges of litigating without an attorney in federal court, especially for incarcerated plaintiffs, this case is in its earliest stages and does not warrant appointment of counsel at this time. Further, discovery has not opened yet, and the Court will not open discovery until there is both a complaint and an answer on file.
