June 11, 2026 Opinion or Order Filing 42 MINUTE ORDER: The #40 Motion to Produce is DENIED. Mr. Bujanda, I am denying your request for documents because discovery has not yet started. This means the parties cannot begin to exchange documents and other information, yet. Furthermore, two of the Defendants in this case have not been served yet. Discovery will begin once any motions to dismiss are resolved, and once Defendants answer in response to any claims that survive their motions to dismiss. I understand you are eager to receive certain documents from Defendants, but I have already denied this premature discovery request once before. See ECF 38. This order constitutes a second denial for the same reasons. Thus, any future requests to receive documents before discovery opens will result in a denial without further explanation. Additionally, in light of the filing of the #39 Amended Complaint, the #30 Motion to Dismiss is found moot. Davis v. TXO Prod. Corp., 929 F.2d 1515, 1517 (10th Cir. 1991) (It is well established that an amended complaint ordinarily supersedes the original and renders it of no legal effect.); Strich v.
