MINUTE ORDER by Magistrate Judge Timothy P O'Hara on 1/29/2026. This matter comes before the Court upon review of Plaintiff's Stipulation for Dismissal of Claims Four through Eleven Against Defendant Jett Trucking, LLC Without Prejudice Pursuant to Fed. R. Civ. P. 41(a)(1)(ii). ECF #13 . Rule 41(a)(1)(A)(ii) provides for voluntary dismissals of actions not claims. By its plain language, 41(a) is not a mechanism for dismissing less than all claims against a Party. See Gobbo Farms & Orchards v. Poole Chemical Co., Inc., 81 F.3d 122, 123 (10th Cir. 1996) (Rule 41(a) does not permit dismissal of less than all claims in an action); Utah Republican Party v. Cox, 177 F. Supp. 3d, 1343, 1372 (D. Utah 2016). Instead, the proper procedure would be to amend the pleading pursuant to Rule 15. Carskadon v. Diva Intern., Inc., No. 12-cv-01886-RM-KMT, 2013 WL 1876784, at *2 (D. Colo. May 3, 2013) (collecting cases); 9 Charles Alan Wright & Arthur R. Miller, Fed. Prac. & Proc. Civ. 2362 (4th ed. 2025). Courts in this district have converted improper 41(a) dismissals into Rule 15 motions. See, e.g., David A. Bovino P.C. v. MacMillan, No. 12-cv-00551-PAB-MEH, 2012 WL 6576973, at *1 (D. Colo. Dec. 17, 2012); Arroyo v. Marriot Corp., No. 19-cv-02483-PAB-NYW, 2020 WL 10320908, at *2 (D. Colo. Jan. 23, 2020); see Fed. R. Civ. P. 1 (Federal rules of civil procedure should be construed, administered, and employed... to secure the just, speedy, and inexpensive determination of any action and proceeding). Accordingly, although the stipulation does not operate as a dismissal of any claims, the Court construes it under Rule 15. Because the stipulation was filed within 21 days of service of a motion to dismiss, Plaintiff is entitled to amendment as a matter of course, and the Court's leave is not required. Fed. R. Civ. P. 15(a)(1)(B). Plaintiff shall file an Amended Complaint on or before February 11, 2026.
