Because Plaintiffs have now filed a timely #59 Amended Complaint, the Motions to Dismiss Plaintiffs' original complaint are moot. See Davis v. TXO Prod. Corp., 929 F.2d 1515, 1517 (10th Cir. 1991) ("It is well established that an amended complaint ordinarily supersedes the original and renders it of no legal effect."); Glass v. The Kellogg Co., 252 F.R.D. 367, 368 (W.D. Mich. 2008) ("Because the original complaint has been superseded and nullified, there is no longer a live dispute about the propriety or merit of the claims asserted therein; therefore, any motion to dismiss such claims is moot."). ORDER. Before the Court is Defendant Crowley DHS's Response to Plaintiffs' Motion for Temporary Restraining Order/Preliminary Injunction. (ECF No. 24.) The Court observes that in its Response Crowley DHS alludes to not having enough pages to give a "comprehensive summary of the Complaint" (and to perhaps flesh out other legal arguments as well). (Id. at 2.) The Court originally imposed the ten-page limit on Crowley DHS's Response when it was of the understanding that it would be receiving three substantive Responsesthe other two coming from Defendants Pueblo DHS and CommonSpirit Health. But those Responses did not cache out as the Court had anticipated. Accordingly, in the interest of justice the Court GRANTS Crowley DHS leave to FILE AN AMENDED RESPONSE, not to exceed 16 pages, exclusive of certificate of service and attorney signature block, by no later than February 3, 2026. ORDER: This matter is before the Court on Plaintiffs' Motion for Temporary Restraining Order and Preliminary Injunction ("Motion") #13 . In light of recent developmentsincluding that the Soltanis' baby was born on January 18, 2026, that the Motion has been withdrawn by Plaintiffs as against Defendant Pueblo County Department of Human Services, and that Plaintiffs' counsel failed to serve the Court's scheduling Order on Defendants by January 17, 2026that portion of the Motion seeking a Temporary Restraining Order is DENIED AS MOOT. These developments further require that the Evidentiary Hearing on the remaining portion of the Motion which seeks a Preliminary Injunction, currently set for January 26, 2026, be RESET to February 12, 2026 at 9:30 a.m. in Courtroom A801. The current briefing schedule on the Preliminary Injunction portion of the Motion is hereby revised as follows: Defendants Crowley County Department of Human Services and CommonSpirit Health shall file their respective Responses to the Motion for Preliminary Injunction by no later than January 30, 2026. These Responses shall each be limited to 10 pages, exclusive of attorney signature block and certificate of service. Plaintiffs shall file their Reply, also limited to 10 pages, exclusive of attorney signature block and certificate of service, by no later than February 6, 2026. In that Reply, in addition to whatever other argument they wish to make in support of their Motion, Plaintiffs are directed to update the Court as to the relief they are still seeking (given the developments mentioned above), as well as to the then-current factual status of this case.
