ORDER Drawing Case and Directing Respondents to File Answer and State Court Record. After review pursuant to D.C.COLO.LCivR 8.1(b), the Court has determined thatthis case does not appear to be appropriate for summary dismissal. Although the parties disagree about the precise contours of Petitioner's claims, there is no dispute that Petitioner is asserting an ineffective assistance of counsel claim and a prosecutorial misconduct claim that are timely and exhausted. Therefore, the case will be drawn to a presiding judge and, if applicable, to a magistrate judge. See D.C.COLO.LCivR 8.1(c). Within thirty days Respondents are directed to file ananswer in compliance with Rule 5 of the Rules Governing Section 2254 Cases that fully addresses the merits of Petitioner's claims. Within thirty days of the filing of the answer Petitioner may file a reply, if any. Within thirty days Respondents are directed to file with the Clerk of the Court, in electronic format if available, a copy of the complete record of Petitioner's state court proceedings in Denver District Court case number 11CR5114, including all documents in the state court file and transcripts of all proceedings conducted in the state court and any physical evidence that are relevant to the asserted claims, by Magistrate Judge Richard T.
