MINUTE ORDER: This matter is before the Court on the #28 Unopposed Motion to Bifurcate Plaintiffs' Claims, wherein the Parties request that this Court "bifurcate Plaintiff's claims into two proceedings": (1) "a bench trial addressing Plaintiff's First and Fourth Claims for Relief," and (2) "a jury trial addressing Plaintiff's Second, Third, Fifth, and Sixth Claims for Relief." [Doc. #28 at 1-2]. Upon review of the Motion, and finding good cause under Rule 42(b) of the Federal Rules of Civil Procedure, Motion is GRANTED. This case will be bifurcated for purposes of trial. First, the Court will conduct a bench trial to determine liability and damages on the uninsured boater claim(s). The bench trial will be set after resolution of any dispositive motions, should any be filed. See [Doc. 32 at 11]; see also NYW Standing Order Regarding Trial and Pre-Trial Procedures B.2. After the conclusion of the bench trial and the Court's issuance of findings of fact and conclusions of law, the Court will preside over a jury trial over the remaining bad faith claims. The Parties are instructed to review the Court's Standing Order Regarding Trial and Pre-Trial Procedures and follow the procedures therein in preparing for the bench trial and subsequent jury trial.
