Filing 16
MINUTE ORDER by Magistrate Judge Timothy P O'Hara on 3/6/2026. For good cause shown, the Court GRANTS Defendant's Expedited Motion for Extension of Time to Respond to Plaintiffs' Motion for Preliminary Injunction #13 . Accordingly, Defendant shall file any Response to Plaintiffs' Motion for Preliminary Injunction #8 on or before March 18, 2026. Having reviewed the Motion and Plaintiffs' Response #15 , the Court does not discern any bad faith from Defendant's request. The Court notes that Plaintiffs assert the extension is sought in bad faith because similar motions have been briefed in other Districts, and Defendant has already filed 9 responses to such motions. #15 at 2. Defendant's request for a 12-day extension is moderate and reasonable, and the Court does not assume that participating in similar litigation outside of this District suggests that Defendant is seeking to delay these proceedings in bad faith. Plaintiffs also object on the basis of prejudice because some Plaintiffs' lawful statuses have already lapsed, and other Plaintiffs' lawful statuses are imminently set to expire. #15 at 2-3. The Court is mindful of these circumstances and intends to timely address the merits of the request for preliminary injunctive relief. To that end, the Court also grants the extension request for its benefit to consider adequate and developed briefing on the issues raised. Once Plaintiffs' Motion for Preliminary Injunction #8 has been fully briefed, the Court will sua sponte set a hearing. Text Only Entry(tpolc2, ) Modified to correct text on 3/6/2026 (jtorr, ).

Filing 14
MINUTE ORDER by Magistrate Judge Timothy P O'Hara on 3/5/2026. Defendant's Unopposed Motion for Leave to File Excess Pages #12 is GRANTED. Defendant may file a response to Plaintiffs' Motion for Preliminary Injunction #8 in excess of the page limit, not to exceed a total length of 40 pages, exclusive of case caption, signature block, and certificate of service. The Court has also reviewed Defendant's opposed Expedited Motion for Extension of Time to Respond to Plaintiffs' Motion for Preliminary Injunction #13 . The Court notes that, to facilitate resolution of cases on the merits, extension requests made before a deadline should typically be granted "in the absence of bad faith by the requesting party or prejudice to another party." Rachel v. Troutt, 820 F.3d 390, 394 (10th Cir. 2016); Fed. R. Civ. P. 6(b)(1)(A). Plaintiffs shall promptly file a response, by no later than the close of business on March 6, 2026, stating any objections on the basis of bad faith or prejudice. No reply is needed. Defendant's response deadline is stayed pending the Court's receipt and consideration of Plaintiffs' response. Text Only Entry(tpolc2, )
