March 18, 2026 Opinion or Order Filing 20 Order GRANTING #19 Great West Casualty Company's Unopposed Motion to Intervene under Federal Rule of Civil Procedure 24. Rule 24(a)(2) gives a party the right to intervene in a civil action in federal court if the party "claims an interest relating to the property or transaction that is the subject of the action, and is so situated that disposing of the action may as a practical matter impair or impede the movant's ability to protect its interest, unless existing parties adequately represent that interest." The Tenth Circuit follows a "liberal" approach to permitting intervention under Rule 24(a)(2). Utah Ass'n of Counties v. Clinton, 255 F.3d 1246, 1249 (10th Cir. 2001). "The central concern in deciding whether intervention is proper is the practical effect of the litigation on the applicant for intervention." San Juan County v. United States, 503 F.3d 1163, 1193 (10th Cir. 2007). Great West has satisfied this standard. Its motion is timely, having been filed at the outset of the litigation. Great West has an interest in the case in light of its lien related to worker's compensation benefits paid to plaintiff. See Elliott Indus. Ltd. P'ship v. BP Am. Prod. Co., 407 F.3d 1091, 1103 (10th Cir. 2005) (listing factors for mandatory intervention). Neither Plaintiff nor Defendant opposes intervention. The motion to intervene is GRANTED. The clerk is directed to amend the caption to include Great West, and Great West is ORDERED to file its Complaint in Intervention no later than 4/1/2026. SO ORDERED by Chief Judge Daniel D.
