March 30, 2026 Filing 21 Unopposed MOTION for Extension of Time to file their Disclosure Statement pursuant to Fed.R.Civ.P. 7.1(a)(2) by Defendants DDBRT-1, LLC, Sunpro Corporation. (Attachments: #1 Proposed Order (PDF Only))(Dawson, Micah)
March 25, 2026 Opinion or Order Filing 20 MINUTE ORDER: In his Order setting the Scheduling Conference and other deadlines, Magistrate Judge Chung reminded the parties of their obligations to file a disclosure statement pursuant to Fed. R. Civ. P. 7.1(a)(2), which "must name-and identify the citizenship of-every individual or entity whose citizenship is attributed to that Party." Plaintiff filed his Notice on February 24, 2026, but Defendants have not yet filed theirs. This is particularly problematic because in their Notice of Removal Defendants state that DDBRT "is incorporated in Utah and has both its headquarters and principal place of business in Utah. Defendant DDBRT is, therefore, a citizen of the State of Utah." However, DDBRT is apparently an LLC. In the Tenth Circuit, for this Court to obtain subject matter jurisdiction based on diversity when an LLC is a party, the citizenship of each member of the LLC must be considered, rather than the LLC's principal place of business. Siloam Springs Hotel, L.L.C. v. Century Sur. Co., 781 F.3d 1233, 1234 (10th Cir. 2015) ("This case requires that we decide how to determine the citizenship, for purposes of diversity jurisdiction, of a limited liability company ("LLC"). Like every other circuit to consider this question, this court concludes an LLC, as an unincorporated association, takes the citizenship of all its members.").Because the Court is duty-bound to police its own jurisdiction, it must be satisfied that complete diversity exists. Therefore, it is ORDERED that Defendants shall file their Notices on or before March 31, 2026. DDBRT must specify the citizenship of each of its LLC members. SO ORDERED by Judge S. Kato Crews on 3/25/2026. Text Only Entry (skclc1)
