| Filing 91 MINUTE ORDER denying #81 Motion to Enforce the Court's April 14, 2026 Minute Order (ECF 63) Or, In the Alternative, For a Status Conference.The Court has reviewed the #81 Motion and #90 Response and agrees with Defendants that there is nothing to enforce. The parties agreed on a process designed to help Plaintiff secure services for his son, but the Court did not issue an order binding Defendants. The last conference clarified several things: (1) CFC services would be denied and excluded from the PAR if TRE deemed them duplicative of DD waiver services; (2) TRE would likely make that finding, and exclude those services, but not others; (3) Plaintiff disagreed with that conclusion; (4) Plaintiff disagreed with Defendants' application of the applicable Medicaid regulations; and (5) despite the parties' disagreements, they could move forward with securing services for Plaintiff's son. Recognizing Plaintiff's continuing objections, the parties agreed to suspend, but preserve, all merits arguments while they pursued the agreed-upon process. However, the #81 Motion suggests Plaintiff has reverted to the same arguments the parties agreed to temporarily set aside. The Court reminds Plaintiff that the parties share one goal: securing services for his son. Those services may not be what Plaintiff believes his son is entitled to, and they may not be delivered in the manner he believes is required, but following the agreed-upon process and reserving those arguments for later would provide meaningful interim assistance while this litigation proceeds. The Motion is DENIED. The Court will review the previously-ordered joint status report, which is due June 22, 2026. ECF 79. Thereafter, the Court will schedule a status conference if one appears to be a good use of judicial resources. On December 1, 2025, the Court implemented a Standing Order Regarding the Use of Generative Artificial Intelligence ("AI") in Court Filings ("Standing Order"). MINUTE ORDER: This matter is before the Court on Plaintiff's #27 Unopposed Motion for Leave to File Excess Pages to Reply in Support of Plaintiff's Emergency Motion for Temporary Restraining Order and Preliminary Injunction ("Motion for Leave"). Plaintiff seeks leave to file a 20-page reply brief to address "numerous factual and legal issues" raised in Defendants' responses. [Doc. 27 at 2]. But several of the issues listed by Plaintiff -- including "ripeness," "Younger abstention," and the "state-created danger doctrine" -- do not appear in Defendants' respective responses. [Id.]. See generally [Doc. #21 ; Doc. #23 ]. Although Plaintiff may address bases for relief that he believes Defendants failed to rebut, it is unclear why he needs additional pages to reply to arguments that do not exist. See BlueRadios, Inc. v. Kopin Corp., No. 16-cv-02052-JLK, 2024 WL 5356869, at *2 (D. Colo. June 24, 2024) ("It is axiomatic that a reply brief is limited to the nonmovant's responses.").
