DISCHARGED ORDER TO SHOW CAUSE: In the #1 Notice of Removal, Greystar, Advenir, and the Spring Canyon Heights TIC entities state that this court has diversity jurisdiction pursuant to 28 U.S.C. 1332. (ECF #1 .) However, the Notice of Removal does not contain any statements regarding the citizenship of the Benedict Canyon Defendants. Moreover, though an LLC's citizenship is determined by the citizenship of its members, see Siloam Springs Hotel, LLC v. Century Sur. Co., 781 F.3d 1233, 1237-38 (10th Cir. 2015), the Notice of Removal merely notes the Spring Canyon Heights Defendants' place of formation and principal place of business. Accordingly, the Court cannot determine whether it has subject matter jurisdiction over this matter. The removing Defendants shall show cause as to why the Court should not recommend the remand of this case on or before April 29, 2026. In lieu of filing a response to this Order, the removing Defendants may file an amended notice of removal.Additionally, the Court notes that the #1 Notice of Removal does not comply with the Local Rules. (See ECF 3.) Pursuant to Local Rule D.C.COLO.LCivR 81.1, and 28 U.S.C. Section 1446a, each of the state court documents filed by a removing party shall be individual PDFs. The removing Defendants filed a single document with several state court exhibits. Any amended notice of removal shall include all exhibits as individual PDFs.
