ORDER: The Parties are advised of the Court's Standing Order Regarding Rule 56 Motions, effective as of October 16, 2026 (the "Rule 56 Standing Order"). The Standing Order is available on the Court's website at: http://www.cod.uscourts.gov/Portals/0/Documents/Judges/NYW/NYW_Standing_Order_Regarding_Rule_56_Motions.pdf. The Standing Order sets forth new procedures that are required prior to the filing of a motion for summary judgment under Rule 56. Specifically, before filing a motion for summary judgment, a party who wishes to move for summary judgment must contact Chambers no later than 10 days after the close of discovery to set a hearing on the party's intent to file a motion for summary judgment. See Rule 56 Standing Order C.1. The Standing Order does not apply in cases in which one or more parties is unrepresented. See id. B.2. In addition, the Standing Order does not apply in cases in which a motion for summary judgment has already been filed and remains pending. If the dispositive motions deadline in this case is on or before November 6, 2026, and the parties believe that extraordinary circumstances warrant relief from the Rule 56 Standing Order, the parties may seek leave of Court to file a summary judgment motion without complying with the Rule 56 Standing Order. Extraordinary circumstances do not include a party's preference to file a summary judgment motion without holding a pre-motion hearing. If the dispositive motions deadline in this case is on or after November 9, 2026, the dispositive motions deadline is VACATED, to be reset by the Court at the pre-motion hearing. Finally, if no party wishes to file a summary judgment motion, then no later than ten days after the close of discovery, the parties shall file a joint motion for a status conference for purposes of setting firm dates for the Final Pretrial/Trial Preparation Conference and the trial. ORDER REFERRING CASE: This case is referred to Magistrate Judge Susan Prose for non-dispositive matters. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ. P. 16(b) and enter a scheduling order meeting the requirements of D.C.COLO.LCivR 16.2, (2) conduct such status conferences and issue such orders necessary for compliance with the scheduling order, including amendments or modifications of the scheduling order upon a showing of good cause, and (3) hear and determine pretrial matters, including discovery and other non-dispositive motions. Court-sponsored alternative dispute resolution is governed by D.C.COLO.LCivR 16.6. On the request of the Parties by motion, this Court may direct the Parties to engage in an early neutral evaluation, a settlement conference, or another alternative dispute resolution proceeding. Alternatively, the Magistrate Judge, at her discretion, may convene such early neutral evaluation and/or settlement conferences and direct related procedures as may facilitate resolution of this case without the necessity of a motion or prior authorization of the undersigned. Counsel for the Parties and all counsel who may later enter an appearance shall review and familiarize themselves with the undersigned's Practice Standards, as well as the Practice Standards of the assigned Magistrate Judge.
