ORDER AND RECOMMENDATION of United States Magistrate Judge: Because the plaintiff was ordered to show cause in writing why his complaint should not be dismissed or else submit a properly amended complaint, and the plaintiff has done neither, it is hereby RECOMMENDED that the case be dismissed without prejudice. Because the defendants have not yet appeared in this action, there has been no opportunities for the parties to consent to magistrate-judge jurisdiction and, accordingly, it is ORDERED that the Clerk of the Court assign this case to a district judge for consideration of this Recommendation. (This case is randomly reassigned to District Judge Charlotte N. Sweeney, and drawn to Magistrate Judge Cyrus Y. Chung for all future proceedings. All future pleadings should be designated as 26-cv-02978-CNS.) Entered by Magistrate Judge Cyrus Y. Chung on 07/27/2026. (agryan) Modified on 8/13/2026 (jdyne, ).
