September 4, 2009	Filing 86 FINDINGS OF FACT AND CONCLUSIONS OF LAW: For the reasons set forth in the attached Findings of Fact and Conclusions of Law, the Court grants Plaintiff's prayer for declaratory relief and declares that Plaintiff, as a vested Participant in the To wn's Pension Plan, is entitled to receive a pension under the Town's Pension Plan and that she may receive those benefits in the form of an annuity or a lump-sum distribution of the contributions she made plus interest, based upon a hire da te of July 1, 1997. The Court declines to retain continuing jurisdiction over this mater. The Clerk is directed to enter Judgment in favor of Plaintiff and to close this case. SO ORDERED. Signed by Judge William I.
