MEMORANDUM OF DECISION: The Court finds Plaintiff Michael Serricchio's damages for lost earnings to be $680,312, less his estimated mitigating earnings of $290,859, for a total back-pay award of $389,453. The Court also awards liq uidated damages in the amount of $389,453, for a total of $778,906, plus prejudgment interest calculated in accordance with 28 U.S.C. § 1961, plus fees and costs. The parties shall submit proposed prejudgment interest calculations with in fourteen days, and any fee application from Plaintiff's counsel shall be submitted within fourteen days. The Court also orders Wachovia to reinstate Serricchio, effective April 1, 2009, according to the terms set forth herein. The Court denie s 222 Plaintiff's motion to strike and denies both parties' 223 , 226 oral motions for judgment as a matter of law. The Clerk is directed to enter judgment in favor of Michael Serricchio in the amount of $778,906, plus prejudgment interest, fees, and costs. It is so ordered.
