Filing 78 ORDER denying the Plaintiffs' 5 Motion for Preliminary Injunction, see attached memorandum of decision; denying as premature the Plaintiffs' 6 Motion for Permanent Injunction, as the standard for a permanent injunction is essentially th e same as the standard for a preliminary injunction, except that the moving party, instead of showing a likelihood of success on the merits must show actual success on the merits. Amoco Prod. Co. v. Village of Gambell, 480 U.S. 531, 546 n. 12 (1987). The parties are referred to Magistrate Judge Thomas P. Smith for a settlement conference and are instructed to file Dispositive Motions regarding the Plaintiffs' allegations and request for permanent Injunctive relief, if any, by October 29, 2010.
