Filing 168 ORDER: Defendants' motion for summary judgment is GRANTED with respect to the state law battery claim and state constitutional claims as to all defendants, and the state law intentional infliction of emotional distress claim as to defendants Mur phy and Lajoie. Because there are no longer any claims outstanding as to Murphy and Lajoie, they are dismissed as defendants in this action. Defendants' motion for summary judgment is otherwise DENIED with respect to plaintiff's federal cla ims against Quiros and plaintiff's state law intentional infliction of emotional distress claim as to defendants Quiros and Cahill. This matter shall proceed to trial against Quiros and Cahill as to the federal constitutional claims set forth in Counts Two through Four and the state law intentional infliction of emotional distress claim set forth in Count Five.
