Defendants' Motion for Reconsideration is GRANTED to the extent it seeks reconsideration of the Court's ruling on Count Two of the complaint, and is DENIED in all other respects. The Court's ruling denying the City's motion for summary judgment on Count Two of the complaint is VACATED and accordingly, the City's motion for judgment on that Count is GRANTED. The c ase shall proceed in a manner consistent with the Court's Order on scheduling, doc. 126. Accordingly, the parties shall file the joint trial memorandum on or before April 10, 2015.
