March 28, 2014 Opinion or Order Filing 287 ORDER denying as moot the Defendant's #207 Motion to Dismiss in light of the Court's #276 , #277 , #278 , 285 , and 286 Orders. Signed by Judge Vanessa L. Bryant on 3/28/2014. (Burkart, B.)
March 28, 2014 Opinion or Order Filing 286 ORDER granting the Defendant's #195 Motion for Joinder. The motions to dismiss the complaint against the Defendant are granted in part and denied in part as explained in the Court's #276 Order. The Defendant's motion to dismiss on standing grounds is DENIED because the Court has ordered joinder of case 12-cv-01721 with this case. See the Court's 285 Order. That newly joined Plaintiff alleges to have used the Defendant's services, which ultimately led to his injury. Signed by Judge Vanessa L. Bryant on 3/28/2014. (Burkart, B.)
March 28, 2014 Opinion or Order Filing 285 ORDER granting the Plaintiffs' #208 Motion to Consolidate Cases. Case number 12-cv-01721 shall be consolidated into this case. This case, docket number 12-cv-00396, shall be the lead case. Signed by Judge Vanessa L. Bryant on 3/28/2014. (Burkart, B.)

Signed by Judge Vanessa L. Bryant on 3/28/2014. (Burkart, B.)
March 28, 2014 Opinion or Order Filing 283 ORDER granting the Defendants' #194 Motion for Joinder. The claims against United Online, Inc., Memory Lane, Inc., FTD Group, Inc., and Classmates International, Inc. are dismissed for the reasons articulated in the Court's #278 and #280 Orders. None of the allegations in the Plaintiffs' Amended Complaint suggest that any of the named Plaintiffs used services from or were otherwise injured by United Online, Inc., Memory Lane, Inc., FTD Group, Inc., and Classmates International, Inc. As a note, Plaintiffs Edward and Lucy Schnabel do allege that their United Mileage Plus credit card was charged $14.99 by Trilegiant, but the Plaintiffs do not allege that they used United Online's website to make any purchases. Since United Online, Inc. is alleged to have been an E-Merchant Defendant, the Plaintiffs were required to allege that they used United Online's services which led to the ultimate injury. From the Complaint, the Court cannot discern the relationship between United Online, Inc. and the Plaintiffs' improper charges on their United Mileage Plus credit card. Accordingly, none of the named Plaintiffs assert any claims that United Online, Inc., Memory Lane, Inc., FTD Group, Inc., and Classmates International, Inc. caused them injury. The claims against them are DISMISSED. Signed by Judge Vanessa L. Bryant on 2/28/2014. (Burkart, B.)

September 20, 2012 Opinion or Order Filing 143 ORDER denying without prejudice to refiling the #137 Motion Seal #136 Amended Complaint. The parties are directed first to Local Rule of Civil Procedure 5(e)3, which expressly states that "No judicial document shall be filed under seal, except upon entry of an order of the Court either acting sua sponte or specifically granting a request to seal that document. Any such order sealing a judicial document shall include particularized findings demonstrating that sealing is supported by clear and compelling reasons and is narrowly tailored to serve those reasons. A statute mandating or permitting the non-disclosure of a class of documents (e.g., personnel files, health care records, or records of administrative proceedings) provides sufficient authority to support an order sealing such documents.... No document shall be sealed merely by stipulation of the parties. A confidentiality order or protective order entered by the Court to govern discovery shall not qualify as an order to seal documents for purposes of this rule." The parties are further directed to Rule 5(e)4 which specifies the three methods of filing under seal. Defendants are therefore ordered to make the requisite showing as to why these documents should be filed under seal by 10/5/2012. Signed by Judge Vanessa L. Bryant on 9/20/2012. (Ives, D)
