Filing 21 RULING (see attached) granting 16 Defendants' Motion to Dismiss Plaintiff's Complaint pursuant to Fed. R. Civ. P. 12(b)(2), 12(b)(5), and 12(b)(6). Plaintiff's 1 Complaint is DISMISSED in its entirety. In particul ar, Plaintiff's federal § 1983 claims in Counts I, II, and III are DISMISSED WITH PREJUDICE in that they each fail to state a claim upon which relief may be granted. In the absence of any remaining federal claims, which were the basis for the Court's original jurisdiction, the Court declines to exercise supplemental jurisdiction over Plaintiff's state law claims, 28 U.S.C. § 1367(c)(3). Plaintiff's state law claims in Counts IV, V, and VII are DISMISSED WITHOUT PREJUDICE to his filing them in state court. The Clerk is directed to close the file. Signed by Judge Charles S.
