Filing 134 ORDER. The motions to dismiss (Docs. #107, #109) are GRANTED as to Counts I, II and III; and DENIED as to Counts IV and V of Saucon's counterclaims and Count IV of DATTCO's counterclaim. The motions for a more definite statement and for tra nsfer of venue are DENIED. DATTCO may amend its counterclaims within 14 days to add a count alleging an exceptional case. In addition, Saucon's Motion for Leave to File Answer, Affirmative Defense and Counterclaims (Doc. #101) is GRANTED, the Ta dayons' Motion for Leave to Enter in the Record Plaintiffs' Stipulation of Covenant (Doc. #102) is GRANTED, and the Tadayons' Motion to Withdraw Plaintiffs' Patent Infringement Claim with Prejudice (Doc. #108) is GRANTED. The only remaining claims in this case are defendants' counterclaims alleging conspiracy to commit fraud and for attorney's fees under 35 U.S.C. § 285. See attached order. Signed by Judge Jeffrey A.
