Filing 31 ORDER. As set forth herein, Defendant Ginnie Mae's 17 Motion to Dismiss is GRANTED. Federal Rule of Civil Procedure 4(m) directs that if service of the summons and Complaint is not made upon a defendant within 120 days after the filing of the Complaint, the action may be dismissed without prejudice after notice to the Plaintiff. More than 120 days have passed since the Complaint was filed and removed to federal court. Plaintiff is hereby given notice that if he does not file pro of of service by September 2, 2014, the case will be dismissed as to Defendant Nationwide Home Mortgage and any other Defendants who have not yet been served.Defendant Homestead Funding Corp., which has been served, shall file a respon se to Plaintiffs Complaint by September 2, 2014. If it fails to do so, then, by September 12, 2014, Plaintiff shall file a motion for entry of default under Federal Rule of Civil Procedure 55 or show cause why the case should not be dismissed as to Defendant Homestead Funding Corp. for failure to prosecute under Rule 41(b).
