For the reasons set forth in the attached ruling, defendant's motion for summary judgment (Doc. # 51 ) is GRANTED, and plaintiff's motion to strike (Doc. # 59 ) is DENIED for subs tantially the reasons set forth in defendant's opposition memorandum (Doc. # 60 ). Because I conclude that no genuine issue of fact remains as to the merits of plaintiff's state law claims, there is no need at this time to consider defendan t's alternative arguments that plaintiff's claims are federally preempted by the terms of the collective bargaining agreement or that they are barred by any settlement agreement negotiated by plaintiff's union representative on his behalf. Filing 65 ORDER GRANTING DEFENDANT'S MOTION FOR SUMMARY JUDGMENT. For the reasons set forth in the attached ruling, defendant's motion for summary judgment (Doc. # 51 ) is GRANTED, and plaintiff's motion to strike (Doc. # 59 ) is DENIED for subs tantially the reasons set forth in defendant's opposition memorandum (Doc. # 60 ).
