Filing 34 RULING (see attached) granting 33 Defendants' Motion for Order to Compel Plaintiff's Deposition and/or For A Nonsuit or Dismissal. As set forth in the attached Ruling, Plaintiff must appear for the purpose of being deposed by Defe ndants on or before June 30, 2017; and counsel must confer to determine the specific date, time, and location for that deposition on or before June 14, 2017. If Plaintiff is missing, fails to appear, and/or otherwise refuses to comply with the notice of his deposition without just cause, the Court will DISMISS his action pursuant to Federal Rule of Civil Procedure 41(b) on the grounds of failure to prosecute. Such a dismissal will constitute an adjudication on the merits. Counsel are directed to note the Ruling's provisions and deadlines regarding an award of sanctions (reasonable expenses and attorney's fees) to Defendants. Signed by Judge Charles S.
