ORDER granting in part and denying in part 28 Motion for Summary Judgment. The case will proceed to trial against Vanek on Counts One (excessive force), Six (assault), and Seven (battery). The case will also proceed to trial against Vanek on Count s Eight (Gross Negligence) and Nine (Recklessness), insofar as those claims concern the manner in which Marsh was placed under arrest and into the vehicle.
