Filing 44 ORDER GRANTING DEFENDANTS' MOTIONS TO DISMISS. For the reasons stated in the attached order, the Court GRANTS the motions to dismiss (Docs. # 22 and # 25 ). The complaint is dismissed with prejudice as to defendants Maya Sparks and Barry Butler pursuant to Rule 12(b)(6) on the ground that they are not state actors subject to suit under 42 U.S.C. § 1983. The Court declines to exercise supplemental jurisdiction as to the state law claims against them. See 28 U.S.C. § 1367(c) (3); Lundy v. Catholic Health Sys. of Long Island Inc., 711 F.3d 106, 117-18 (2d Cir. 2013). The complaint is dismissed with prejudice as to the remaining defendants, including Brown, Stempien, and Vongroski, pursuant to Rules 12(b)(2) and 12(b)(5) due to insufficient service of process and Rule 8 due to prolixity.
