Filing 54 ORDER granting in part and denying in part 39 Motion to Dismiss. The motion is denied with respect to the Monell and indemnification claims against the City of New Haven and Pastore, acting in his official capacity. The motion is granted to the extent that it seeks to exclude from Lewis's direct action claim any intentional tort claims. The defendants shall file an answer to Lewis's complaint by February 19, 2017 and shall comply with the discovery and motion deadlines I imposed on the other parties on December 15, 2016 (doc. 47).
