Filing 46 ORDER granting 30 Motion for Summary Judgment. M.M. has not indicated whether she seeks liquidated damages or actual damages pursuant to 18 U.S.C. § 2255(a). In light of that fact, I hold entry of final judgment in abeyance. I grant M.M. le ave to seek actual damages, costs, and/or attorneys' fees within fourteen days of entry of this order, on or before August 15, 2023. If no motion for actual damages, costs, and/or attorneys' fees enters on or before the deadl ine, the Clerk shall enter judgment in the statutory minimum amount of $150,000 on August 16, 2023. Filing 22 ORDER DISMISSING CASE. For the reasons set forth in the attached order, this matter is hereby dismissed without prejudice pursuant to Federal Rule of Civil Procedure 41(b). If Plaintiffs wish to pursue this action, they may file a motion to reopen the case within thirty days, on or before October 17, 2022. Any motion to reopen must set forth good cause for the failure to prosecute and to comply with court orders, and a basis for reopening the case. If Plaintiffs fail to file a motion to reopen that complies with this order by October 17, 2022, the Court will convert this dismissal into one with prejudice.
