Filing 52 MEMORANDUM OF DECISION. As set forth in the attached ruling, the Court concludes that plaintiff Jeffrey Nuzzo has failed to prove by a preponderance of the evidence that defendants Sergeant Mark Devine and Trooper Matthew Warren should be liable to h im for the use of excessive force in violation of the Fourth Amendment. Pending motions (Docs. # 36 and # 49 are DENIED as moot. The Clerk of Court shall enter judgment in defendants' favor and close this case. It is so ordered. Signed by Judge Jeffrey A.
