March 25, 2020 Opinion or Order Filing 18 ORDER. For the reasons set forth in the attached, the defendant's 15 motion for summary judgment is GRANTED in part and DENIED in part.Contrary to what is stated in the Scheduling Order, ECF No. 11, the parties' Joint Trial Memora ndum will be due within 60 days of this ruling. The case will be considered trial ready 15 days after the filing of the Joint Trial Memorandum. The Court will set a date for jury selection after reviewing the Joint Trial Memorandum. If the parties are interested in referral to a U.S. Magistrate Judge for mediation, they should file a joint statement certifying that (1) counsel have conferred with their clients and each other, (2) the parties wish to proceed to mediation, (3) the parties are willing to participate in settlement efforts at such mediation in good faith, and (4) counsel believe that a mediation stands at least a reasonable chance of resolving the case without trial.Signed by Judge Michael P.
