February 7, 2023 Opinion or Order Filing 350 RULING ON MOTIONS FOR PARTIAL SUMMARY JUDGMENT. For the reasons set forth in the attached ruling, the Court DENIES the motion of Express Scripts for partial summary judgment (Doc. # 276 ). The Court GRANTS in part and DENIES in part the motion of Hen kel for partial summary judgment (Doc. # 285 ). I award Henkel summary judgment on two points. First, the decision to approve the drugs will be reviewed for abuse of discretion for purposes of determining ReliaStar's coverage obligations. And se cond, Express Scripts was acting as a fiduciary when it approved the prescription for Haegarda that was subject to an appeal. The Court GRANTS in part and DENIES in part the motion of ReliaStar for summary judgment (Doc. # 281 ). Counts Two and Four are dismissed, and Count Three is limited to the theory that ReliaStar misrepresented in 2016 whether the 2017 stop-loss insurance policy would cover the drugs.
