Filing 10 ORDER. For the reasons set forth in the attached, the Eighth Amendment claim is DISMISSED pursuant to 28 U.S.C. 1915A(b)(1). Within twenty (20) days of the date of this order, plaintiff shall file a response setting forth any attempts that he made, prior to filing this action, to exhaust administrative remedies as to the Fourteenth Amendment failure to protect/deliberate indifference to safety claim and the First Amendment retaliation claim by using the Department of Corrections grievance procedures set forth in Administrative Directive 9.6. Failure to comply with this order will result in dismissal of the First and Fourteenth Amendment claims for failure to exhaust administrative remedies. Any such dismissal would be without prejudice to the plaintiff filing a new action to assert those claims after fully exhausting his available administrative remedies. Signed by Judge Michael P. Plaintiff's motion does not specify a concrete basis to compel the defendant to preserve evidence on an emergency basis, besides the Department of Corrections' supposed 30-day policy on recycling video footage and an unsupported, conclusory assertion that the Department of Corrections has a tendency to dispose of evidence. Defendant is already on notice and is hereby reminded of his obligation to preserve relevant evidence pertaining to the case. The Court may impose sanctions, including monetary sanctions, adverse inferences, or default judgment, in the event relevant evidence is destroyed after the lawsuit was filed.Signed by Judge Michael P.
