ORDER: The petitioner's motion to vacate, set aside, or correct sentence pursuant to 28 U.S.C. 2255 by a person in federal custody (Doc. No. #1 ) is hereby DISMISSED without prejudice to refiling under the correct provision. The petitioner is attacking a state court rather than a federal court judgment and should seek relief pursuant to 28 U.S.C. 2254 not 2255. The Clerk shall send the petitioner the appropriate form along with this order and close this case. The petitioner should note that there is a $5 filing fee for a 2254 petition.
