November 27, 2018 Opinion or Order Filing 4 ORDER: The #1 petition is DISMISSED for lack of subject matter jurisdiction. A habeas petition challenging the legality of a prisoner's conviction should be brought under 28 U.S.C. 2255, not 28 U.S.C. 2241. See Cephas v. Nash, 328 F.3d 98, 104 (2d Cir. 2003). Moreover, the record establishes that this petitioner has not yet been sentenced for his federal convictions. Therefore, his petition is premature. See U.S. v. Gonzalez, No. 00-CR-447 (DLC), 2001 WL 987866 (S.D.N.Y. Aug. 30, 2001). The petitioner may challenge his convictions via direct appeal or 2255 petition following his sentencing.
