For the reasons set forth in the attached recommended ruling, the Court recommends that the #9 Amended Complaint be DISMISSED, without prejudice to one further opportunity for re-filing. Plaintiff may file a second amended complaint on or before January 25, 2019, alleging an adequate jurisdictional basis, if he wishes to proceed with this matter in federal court. December 20, 2018 Opinion or Order Filing 7 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without payment of fees and costs, which motion includes a sworn statement as to plaintiff's current financial circumstances. See Doc. #2 . Although that motion is not signed, and the sworn statement contains de minimis information concerning plaintiff's financial circumstances, the Court nevertheless grants plaintiff's motion in light of its forthcoming recommendation that the Complaint be dismissed for a lack of subject matter jurisdiction. Additionally, the scant information that is provided in the sworn statement suggests that plaintiff is likely eligible for in forma pauperis status given that his monthly income is less than his monthly obligations. See id. at 3-5. 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. It is so ordered. Signed by Judge Sarah A. L. Merriam on 12/20/2018.
