ORDER: The 2255 motion to vacate, set aside, or correct sentence is premature as the petitioner has not yet been sentenced for his federal convictions. See U.S. v. Gonzalez, 2001 WL 987866, at *2 (S.D.N.Y. Aug. 30, 2001) (explaining that 2255 "allows a motion only by a prisoner in custody under sentence of a court" and "where a federal prisoner has not yet been sentenced, a district court lacks jurisdiction over a motion pursuant to Section 2255").
