Filing 9 NOTICE of Appearance by Sixtina Fernandez on behalf of Nancy A. Berryhill (Fernandez, Sixtina) |
Filing 8 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without prepayment of fees, costs or security therefor, which includes an affidavit regarding his current financial circumstances. See Doc. #2 . This is plaintiff's second appeal of the Social Security Administration's denial of benefits, and plaintiff has previously been granted leave to proceed in forma pauperis. See Brown v. Berryhill, No. 3:17CV01108(SALM), Doc. #10. In plaintiff's motion in the instant case, he states that he has two dependent children, one of whom is still a minor, and that his family is supported by a single income of approximately $1,000 per week. See Doc. #2 at 2-3. This income does not cover the family's basic monthly expenses. See id. at 3-5. Plaintiff has limited assets and significant debts. See id. at 4. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. It is so ordered. Signed by Judge Sarah A. L. Merriam on 2/5/19. (Dowie, C) |
