Filing 8 ORDER DISMISSING COMPLAINT WITHOUT PREJUDICE. Plaintiff has filed a lengthy complaint that names the "Waterbury City Police" as a defendant and "et al." but without naming as required by Fed. R. Civ. P. 10(a) any other defendant in the caption of the complaint. Doc. #1. The complaint contains a very lengthy recitation of facts about plaintiff's alleged mistreatment by various officials relating to plaintiff's hospitalization at Waterbury Hospital and Connecticut Valley Hospital. The complaint does not otherwise contain allegations that give rise to plausible grounds for relief against the Waterbury police department. Moreover, the Waterbury police department is not an entity subject to suit. See, e.g, Atkinson v. Norwalk Police Dep't, 2019 WL 108877, at *1 (D. Conn. 2019). Accordingly, the Court dismisses the complaint without prejudice to re- filing of an amended complaint that lists by name in its caption each of the defendants whom plaintiff wants to sue and that sets forth a plain and simple statement of factual allegations as to each named defendant that would give rise to plausible grounds for relief. Signed by Judge Jeffrey A. Meyer on 02/28/19. (Barry, Donna) |
Filing 7 ORDER DENYING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS. Plaintiff has filed a motion for leave to proceed in forma pauperis by filing a duplicate copy of his complaint rather than a document that states plaintiff's financial condition. The Court DENIES plaintiff's motion for leave to proceed in forma pauperis without prejudice to plaintiff's filing of a renewed motion with affidavit substantiating any claim of inability to pay the Court's filing fee. Signed by Judge Jeffrey A. Meyer on 02/28/19. (Barry, Donna) |
Filing 6 ORDER DENYING MOTION TO TRANSFER. The Court DENIES plaintiff's motion to transfer to another judge (Doc. #5) for failure to identify legitimate grounds why Judge Meyer should be recused from this case. Signed by Judge Jeffrey A. Meyer on 02/28/19. (Barry, Donna) |
