March 21, 2019 Opinion or Order Filing 11 AMENDED SCHEDULING ORDER. The Commissioner shall file an answer and the administrative record by April 22, 2019. Plaintiff shall file a motion to reverse or remand the decision of the Administrative Law Judge and/or Appeals Council by June 21, 2019. The motion shall be accompanied by a memorandum of law explains the reasons why plaintiff believes the decision should be reversed or remanded for reconsideration, specifically addressing whether there was an error of law or a lack of substantial evidence to support the decision below. See, e.g., Greek v. Colvin, 802 F.3d 370, 374-75 (2d Cir. 2015) (per curiam). The Commissioner shall file any response and motion to affirm by August 20, 2019. The parties should confine their statements of fact to the statements of fact that are material to the arguments that they make in their briefing. The parties should consult the Court's Standing Scheduling Order for the requirements concerning content and format of briefing. Doc. #4. The parties are advised that the Court is unlikely to grant an extension of time of the dates as set forth in this scheduling order, and that failure to comply with the Courts scheduling order may result in a summary grant of relief for the opposing party. February 21, 2019 Opinion or Order Filing 6 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without prepayment of fees, costs or security therefor, which includes an affidavit regarding his current financial circumstances. See Doc. #2 -1. In plaintiff's motion, he states that he is self-employed, performing "odd jobs doing light carpentry[.]" See id. at 2. Plaintiff claims to earn $500 each month for this work, and states that he supplements this income with $800 per month in food stamps and $900 each month in other government benefits. See id. at 2. These sources of support do not cover plaintiff's monthly expenses. See id. at 2-5. Plaintiff has no assets and five dependents, his spouse and four minor children. See id. at 1, 4-5. Plaintiff states he: "Emigrated as a war refugee from Syria[.]... Has been having to charge to credit cards to survive-- owes about $10,000 on credit cards[.]" Id. at 5. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. It is so ordered. Signed by Judge Sarah A. L. Merriam on 2/21/19. (Dowie, C)
