As discussed on the record during the May 9, 2019, in-person status conference, the self-represented plaintiff shall file a Second Amended Complaint on or before the close of business on May 17, 2019. The Second Amended Complaint must address the deficiencies identified in the Court's April 9, 2019, Recommended Ruling (Doc. #10 ), a copy of which was given to plaintiff during the in-person status conference. The Second Amended Complaint must be captioned "Second Amended Complaint," and will completely supersede, that is, replace, both the #1 Complaint and the #11 Amended Complaint. Plaintiff is reminded that her filings with the Court must comply with the Federal and Local Rules of Civil Procedure which, as the Court explained at the conference, are available on the Court's website at www.ctd.uscourts.gov. The Court will review plaintiff's Second Amended Complaint pursuant to 28 U.S.C. 1915(e). Should the Second Amended Complaint fail to state a claim, or otherwise fail to cure the deficiencies identified in the Recommended Ruling, then the Court may recommend that plaintiff's case be dismissed, with prejudice. April 9, 2019 Opinion or Order Filing 10 RECOMMENDED RULING. For the reasons stated in the attached recommended ruling, the Court recommends that the #1 Complaint be DISMISSED, without prejudice to re-filing. If plaintiff wishes to pursue her claim(s), she must file an amended complaint that sets forth a clear statement of her claims on or before May 9, 2019. 16 pages. This is a recommended ruling. Any objections to this recommended ruling must be filed with the Clerk of the Court within fourteen (14) days of being served with this order. See Fed. R. Civ. P. 72(b)(2); 28 U.S.C. 636(b)(1). April 9, 2019 Opinion or Order Filing 9 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without payment of fees and costs, which motion includes a sworn statement as to plaintiff's current financial circumstances. See Doc. #2 . Plaintiff has completed the required information. Plaintiff asserts that she is unable to afford to pay fees and costs, as nearly the entirety of her currently monthly income covers the monthly expenses for her and her minor child. See generally id. at 2-5. Plaintiff also states that she lives in Section 8 housing and receives food stamps. See id. at 4-5. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. It is so ordered. Signed by Judge Sarah A. L. Merriam on 4/9/2019. (Katz, S.)
