June 4, 2019 Opinion or Order Filing 29 ORDER granting #26 , #27 Motions for Protective Order: As the Court has repeatedly emphasized since this case was removed, there are only two issues pending before the Court, both of which were raised in the Court's Order to Show Cause, ECF No. 8: (1) the threshold jurisdictional issue; and (2) the proposed filing injunction. No discovery is required for Mr. Koch to address these issues, nor has the Court ordered or otherwise permitted any at this time. See FED. R. CIV. P. 26(d)(1) ("A party may not seek discovery from any source before the parties have conferred as required by Rule 26(f), except in a proceeding exempted from initial disclosure under Rule 26(a)(1)(B), or when authorized by these rules, by stipulation, or by court order."); see also Digital Sin, Inc. v. Does 1-176, 279 F.R.D. 239, 241 (S.D.N.Y. 2012) (noting that "parties generally may not initiate discovery prior to satisfying the meet and confer requirement of FED. R. CIV. P. 26(f)...."). Because the Court would, accordingly, not require any discovery to be produced by Ms. Koch or her counsel at this time, the Court GRANTS Plaintiff's motions, under its inherent authority to manage its docket and courtroom "with a view toward the efficient and expedient resolution of cases," Dietz v. Bouldin, 136 S. Ct. 1885, 1892 (2016), as it is not necessary for the Court to engage in litigation over the motions to quash the subpoenas which might further delay these proceedings. May 30, 2019 Opinion or Order Filing 20 ORDER VACATING 9 Order Granting in Part and Denying in Part #3 Motion by Self-Represented Litigant to Participate in Electronic Filing, and GRANTING IN PART #3 Motion by Self-Represented Litigant to Participate in Electronic Filing. On April 2, 2019, the Court exercised its discretion in denying Mr. Koch permission to file electronically, as electronic filing by self-represented litigants is not a matter of right in this District. See Fed. R. Civ. P. 5(d)(3)(B) ("A person not represented by an attorney: (i) may file electronically only if allowed by court order or by local rule...."); D. Conn. Electronic Filing Policies and Procedures, revised Oct. 11, 2018, I(D) ("Electronic filing by self-represented and prisoner parties will generally not be permitted at this time, although self-represented non prisoner parties may file a motion for permission to electronically file documents."). The Court did, however, permit Mr. Koch to receive electronic notifications/notices issued by the Court. Mr. Koch has since objected to these notices and repeated his requests for permission to file electronically.Under its inherent authority to manage its docket and courtroom "with a view toward the efficient and expedient resolution of cases," Dietz v. Bouldin, 136 S. Ct. 1885, 1892 (2016), the Court hereby VACATES the Court's April 2, 2019 Order (ECF No. 9) and GRANTS IN PART Mr. Koch's Motion to Participate in Electronic Filing (ECF No. 3). Because the court has given Mr. Koch the additional opportunity to respond in writing to its Order to Show Cause by June 7, 2019 at 4:00 p.m., see ECF No. 19, Mr. Koch shall be permitted to participate in electronic filing until June 7, 2019.The Clerk of the Court is respectfully directed to provide Mr. Koch with the information he needs to file electronically in this matter. May 29, 2019 Opinion or Order Filing 19 Minute Entry for proceedings held before Judge Victor A. Bolden and ORDER: The Court held a telephonic Show Cause Hearing on May 29, 2019. Total Time: 18 minutes (Court Reporter S. Montini.) Paul Koch appeared pro se and Ms. Koch appeared through counsel, Marianne Joan Charles. After the hearing began, Mr. Koch stated that he was having technical difficulties hearing the Court and then disconnected, but did not call back in to rejoin the hearing.The Court has twice noted its concern that Mr. Koch "is attempting to unduly prolong these proceedings." Despite multiple extensions, Mr. Koch has not filed any response to the Court's Order to Show Cause, nor addressed the threshold jurisdictional issue or the proposed filing injunction raised therein during his appearances.Nevertheless, in light of this Court's obligation "to make reasonable allowances to protect pro se litigants from inadvertent forfeiture of important rights because of their lack of legal training," Traguth v. Zuck, 710 F.2d 90, 95 (2d Cir. 1983), the Court will permit Mr. Koch one final opportunity to respond to the Court's Order to Show Cause. Mr. Koch may file that submission by June 7, 2019 at 4:00 PM. This final extension is the "appropriate degree of special solicitude" due to Mr. Koch as a pro se litigant with experience bringing cases in this District. See Tracy v. Freshwater, 623 F.3d 90, 102 (2d Cir. 2010) (explaining that "the degree of solicitude may be lessened where the particular pro se litigant is experienced in litigation and familiar with the procedural setting presented" and that "it falls well within a district court's discretion to lessen the solicitude that would normally be afforded.").After this deadline has passed, the Court will rule on the jurisdictional and filing-injunction issues that are raised in the Court's Order to Show Cause.Signed by Judge Victor A.
