Filing 7 ORDER. Plaintiff filed this action on June 13, 2019, alleging an all-encompassing criminal conspiracy between Alfonso "Alfy" Fanjul and the Federal Bureau of Investigation. The complaint describes a litany of prior litigation that Plaintiff has brought in various federal courts. A search of federal court records via PACER.gov reveals that Plaintiff filed complaints substantially identical to this one in the District of Massachusetts and the Southern District of New York. Plaintiff was prohibited from filing his complaint in New York pursuant to an earlier filing injunction. The court explained that the action was "not a departure from Plaintiff's pattern of frivolous litigation." Papadopoulos v. U.S. Government (FBI), No. 19-4597 (S.D.N.Y. May 22, 2019). In Massachusetts, the court held that Plaintiff's complaint was barred by the doctrine of res judicata based on lawsuits Plaintiff brought against the same parties in 2010 and 2011. Papadopoulos v. U.S. Government et al., No. 19-1131 (D. Mass. July 18, 2019) ("Here, a federal court in New York has already dismissed suits based on the same allegations against the same defendants. Accordingly, the instant complaint is subject to dismissal for failure to state a claim upon which relief may be granted and under the principal of res judicata."). I agree with the reasoning in those cases. As a result, the complaint is hereby DISMISSED pursuant to 28 U.S.C. 1915(e) because Plaintiff's claims are plainly frivolous and are barred under the doctrine of res judicata. The #2 motion for leave to proceed in forma pauperis and #3 motion for preliminary injunction are DENIED as moot. The Clerk is directed to close this case. I hereby certify that no appeal from this decision could be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See 28 U.S.C. 1915(a)(3).
