Filing 11 ORDER. Pursuant to the referral of Judge Kari A. Dooley, the Court has reviewed the self-represented plaintiff's #9 Amended Complaint pursuant to 28 U.S.C. 1915(e)(2). See Doc. #10. Liberally construing the allegations of the Amended Complaint, plaintiff appears to assert a procedural due process claim pursuant to section 1983 for the alleged termination of his Section 8 housing benefits. Because plaintiff seeks both injunctive and monetary relief, see Doc. #9 at 2, the Court construes plaintiff's Amended Complaint as attempting to assert claims against defendant Trisha Malloy in both her individual and official capacities.Accordingly, the Court will permit the #9 Amended Complaint to proceed to service at this time. The Clerk of the Court is directed to send the self-represented plaintiff a copy of this Order, together with a service packet. Plaintiff shall complete the papers contained in the service packet and mail them back to the Clerk's Office, who shall then give the completed packet to the U.S. Marshals for service. Plaintiff also asserts that his monthly benefits are less than his monthly obligations. See generally id. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. 28 U.S.C. 1915(a)(1).
