ORDER DENYING MOTION FOR PROTECTIVE ORDER AND TO STAY DISCOVERY (Doc. #19). The Court DENIES plaintiff's motion for protective order and to stay discovery. Although plaintiff argues that discovery should be stayed pending resolution of whether this case will be remanded to state court, no matter whether this action ultimately proceeds in state court or federal court, the parties will need to conduct discovery, and discovery should proceed all the same. Because it is plaintiff who has decided to initiate this litigation, it is not too much to ask that plaintiff cooperate in the prompt production of discovery. As to plaintiff's request that the Court enter an expedited ruling on the motion remand, the Court will allow defendant an appropriate time to respond and cannot assure plaintiff that it will issue an expedited ruling. If the parties have a dispute about the scope of any discovery request, they should adhere to Judge Meyer's Instructions for Discovery Disputes, which is available on Judge Meyer's court webpage. | Filing 17 GENERAL SCHEDULING ORDER. The Court has reviewed the parties' proposed Rule 26(f) reports and declines to accept the parties' proposed dates as too lengthy in light of the facts of this case involving a single incident involving plaintiff's injury from a fall. The Court sets forth the following case schedule. The parties shall file any further motions to amend the pleadings or join additional parties by September 24, 2019. All fact and expert discovery shall be completed (not propounded) not later than September 1, 2020. Counsel shall consult and agree in writing upon interim dates that are necessary to ensure the timely completion of all discovery. Any dispositive motions shall be filed by October 1, 2020. The parties shall file a joint trial memorandum by October 1, 2020, or within 30 days of the Court's ruling on any dispositive motions, whichever date is later. Please refer to Judge Meyer's webpage on the District of Connecticut website for Judge Meyer's "Instructions for Discovery Disputes" and "Instructions for Joint Trial Memorandum" and "Pretrial Preferences" and "Trial Preferences." The parties are encouraged to commence discovery forthwith and to arrange their schedules in contemplation of the briefing deadlines for any dispositive motions, because the Court is unlikely to grant a future request for an extension of the scheduling order absent extraordinary and unforeseeable circumstances.
