September 16, 2019 Opinion or Order Filing 14 ORDER. The self-represented plaintiff contacted the chambers of the undersigned today and left a voice mail message inquiring about the status of a pending motion for appointment of counsel. (Doc. #3 ) The plaintiff is advised that the Court is unable to discuss case-related matters with parties off the record, by telephone. Furthermore, the Court notes that the motion for appointment of counsel is not pending before the undersigned, but before Judge Janet C. Hall. The Court will rule on the motion in due course; however, plaintiff must be prepared to proceed with this matter as a self-represented party, or retain counsel on her own. There is no right to the appointment of counsel in a civil matter, and plaintiff has represented that she only contacted one attorney regarding this matter, see Doc. #3 at 4-5, which ordinarily is not sufficient to establish that plaintiff has made sufficient efforts to obtain counsel on her own. Plaintiff should carefully review all materials docketed in this matter, and all materials mailed to her, and ensure that she takes the necessary steps to ensure service of process. September 6, 2019 Opinion or Order Filing 11 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without payment of fees and costs, which motion includes a sworn statement as to plaintiff's current financial circumstances. See Doc. #2 . Plaintiff has completed the required information. She asserts that she is unable to afford to pay fees and costs, having no income, minimal assets and significant outstanding debt. See generally id. at 3-5. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. The Court has also reviewed the Complaint #1 pursuant to 28 U.S.C. 1915(e)(2) and finds that the claims asserted, specifically, violations of the Americans with Disabilities Act (ADA), may proceed to service of process on the defendant. The Court notes that the Complaint makes a reference to the Family and Medical Leave Act (FMLA). See Doc #1 at 7. However, Plaintiff does not appear to be seeking relief under that statute.
