Filing 35 ORDER: On November 12, 2019, this Court issued a Memorandum of Telephonic Status Conference (see Doc. No. 33), directing the parties to file a motion to continue or a stipulation by November 13, 2019. The Court directed the parties to file a motion to continue in light of defense counsel's representation during the November 12th call (see Doc. Nos. 31-32) that he is unavailable for the prejudgment remedy hearing scheduled for Friday, November 15, 2019. On November 13, 2019, the plaintiff filed a "Notice of DRAFT Stipulation -- subject to potential objection by defendant." Construing this "Notice" as a Motion to Continue, the prejudgment remedy hearing set for November 15, 2019 is cancelled. If the defendant intends to file an objection to the Draft Stipulation, he shall notify the Court immediately and, if necessary, a new date for a prejudgment remedy hearing will be set.
