Plaintiff initially filed a motion for leave to proceed in forma pauperis that did not include plaintiff's signature, which is required under the statute. See 28 U.S.C. 1915(a)(2). October 15, 2019 Opinion or Order Filing 6 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff's counsel has filed a motion on plaintiff's behalf seeking to proceed without payment of fees and costs. The motion is signed by counsel, as an officer of the court, and attached to the motion is a statement regarding plaintiff's current financial circumstances. See Doc. #2 . It appears that the form affidavit was completed by plaintiff's counsel or a member of her staff. The form states that it was completed with the assistance of plaintiff's spouse, because plaintiff is "too impaired to complete + sign @ this time." Id. at 5. The statute requires that plaintiff submit an affidavit in support of any application to proceed in forma pauperis. See 28 U.S.C. 1915(a)(2). However, here, counsel asserts that plaintiff is unable to assist with such an affidavit. This matter relates to a claim that plaintiff is entirely disabled. It would be inequitable to refuse to permit the matter to proceed if, indeed, plaintiff is too disabled at this time to assist in her own case. Accordingly, at this time, the Court will accept the statements of plaintiff's counsel on behalf of plaintiff. The motion asserts that plaintiff is unable to afford to pay fees and costs, having no employment, and no assets. See generally Doc. #2 at 3-4. The motion further states that plaintiff receives cash assistance and SNAP benefits through the State of Connecticut. See id. at 3-5. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. The requirement of an affidavit cannot be permanently waived. Accordingly, on or before December 6, 2019, plaintiff shall file either (1) an affidavit signed by plaintiff personally, or (2) an affidavit of a person appointed as a conservator for plaintiff.
