January 16, 2020 Opinion or Order Filing 23 ORDER granting #20 Motion to Set Aside Default because the Defendant Collateral Recovery Services, LLC, has now appeared. The Court concludes, based on the Defendant's Declaration in Support of Motion to Set Aside/Vacate Default, that the default was not willful and that setting aside the default would not prejudice the Plaintiff. Under Federal Rule of Civil Procedure 55(c), the Court may set aside an entry of default "for good cause." "Good cause... should be construed generously." Enron Oil Corp. v. Diakuhara, 10 F.3d 90, 95 (2d Cir. 1993). Courts consider the following factors when ruling on motions to set aside a default entry: "(1) whether the default was willful; (2)whether setting aside the default would prejudice the adversary; and (3) whether a meritorious defense is presented." Id. "[B]ecause defaults are generally disfavored and are reserved for rare occasions, when doubt exists as to whether a default should be granted or vacated, the doubt should be resolved in favor of the defaulting party." Id. Accordingly, the Court sets aside this default. Signed by Judge Victor A. Bolden on 1/16/2020. (Leon, Noel)
